    I’ve been told by an architect that I can’t extend on the top of my existing kitchen extension due to the placement of my neighbours windows and them needing a 45 degree view. We’re semi detached and a lot of houses in our area have this extension already. Does anyone know if there is a way round it? He’s said we could go to 2m and I’m guessing the kitchen extension is approx 3m. An upstairs extension would enable us to keep our 3 bedrooms but move our bathroom upstairs as its currently off the kitchen. Thank you

    Depending on how close your are to your neighbours and when your kitchen extension was built this might be a permitted development

    The 45 degree rule is normally just a basic guideline … I would suggest getting pre-application planning advice from your LPA.

    It sounds like this is a ‘right to light’s issue., Rather than a view. Do you know what the window in question serves? Only ‘habitable’ rooms have a right to light. If it’s a bathroom or landing they don’t have a right to light. If it’s a bedroom it does, but you may be able to do something with the roof of your extension to reduce it’s impact on your neighbours right to light.

    Find another architect and take some more advice from one

    Believe if there is similar extensions in the area then the Planning Authority takes this into consideration as long as your neighbors don’t complain
